What Is The California Lemon Law?
The California lemon law, also known as The Song Beverly Consumer Warranty Act, is the law the protects consumers when they purchase a vehicle or product that the manufacturer is unable to repair under warranty.
There are three main ways to qualify for the lemon law:
- Implied Warranty: This means your car wasn’t up to normal standards within the first year after purchase.
- Express Warranty: You take your car in multiple times for the same issue and the dealer can’t fix it.
- 30 Day Rule: The dealership has your car for over 30 days for the same repair.

What Am I Entitled To If I Have A Lemon?
Generally, if you have a lemon you are entitled to either a repurchase (also called a buyback) or a replacement. Another settlement option is a cash and keep where you are paid some money but keep the loan/lease on the vehicle. In this car market, cash and keep settlements are something to consider. By using your car’s equity plus the settlement from the manufacturer, you may be able to maximize the money in your pocket!
What Does A Repurchase Consist Of?
A repurchase, also known as a buyback, consists of a return of your down payment, payments, out of pocket repair costs, towing, rental costs, and loan payoff, less the mileage offset, and less any aftermarket additions.

The Manufacturer wants me to sign something in exchange for a few payments. Should I Agree To This?
If the manufacturer offers to reimburse you for a few payments due to the problems with your car without making you sign anything, great. However, what manufacturers have been doing is offering a a few payments in exchange for a waiver of your rights (this will be buried in a lot of legal mumbo jumbo). Chances are you already have a case, and the manufacturer is trying to trick you into giving up your rights over something you’re already entitled to. How Many Times Do I Need To Take My Car In For It To Be A Lemon?
There’s no one size fits all magic number to answer this question, but the law does provide some basic guidelines within the first 18 months or 18,000 miles after purchase of a new car or truck:
- At least two repair visits for serious, safety related issues
- At least four times for almost any other issue
- At least 30 days for one repair visit
